The premise behind Gardasil was unique in that it was prescribed to prevent the possibility of cancer rather than to treat it. Gardasil is manufactured by the Merck Company and was introduced into the market and approved by the FDA in 2006 for use by females from age 9 to 26.

The primary reason for administering this vaccine is to prevent the potential for contracting the human papillomavirus or HPV, which is a leading cause of cervical cancer. The premise of vaccinating young women ahead of time was met with a huge response with more than 8 million young girls and woman receiving the injections.

But from the start, Gardasil had over 8,000 reactions that were documented by Federal health officials. While the pros of protecting young girls and women from a potentially deadly form of cancer, the side effects of the drug include immune system disorders, paralysis, seizures, pancreatitis and brain damage. It has been linked to 18 deaths.

Some of the reports were hard to blame solely on Gardasil as many of the young girls who received the vaccine updated other vaccines that they needed at the same time such as shots to prevent chickenpox, tetanus, hepatitis and flu. But out of a series of woman who only had the Gardasil injections, those who experienced side effects or died did not have any medical problems in their past and showed signs of side effects after the second or third shot.

Many doctors are torn over the value of using Gardasil to prevent the HPV feeling that the risks are not worth it. One medical doctor who is a regular critic of the major pharmaceutical companies says that in 90 percent of the cases, the body is strong enough to fight off the virus that causes the cancer without the use of Gardasil.

One of the problems that people may wrongly assume is that they cannot receive any compensation for illness, side effects or injuries that are a result of receiving the Gardasil injections. In 1998, the federal government set up a no-fault system run by the Federal Court of Claims called the Vaccine Injury Compensation Program (VICP). This program was created to allow victims of vaccines or immunizations to receive compensation for their injuries or side effects without having to prove who was at fault.

It is an easier process and since its inception more than 7000 vaccine claims have been filed. More than $1 billion dollars has been awarded to over 2000 families and individuals. And as a result of the claims, companies have been encouraged to develop safer vaccines and immunizations. The process is best handled by an attorney who is familiar with the whole system.
