While the makers of Boniva and Actonel battle it out in court over Boniva ad claims, Merck, the maker of Fosamax has not yet become a part of the lawsuit. Hoffman-LaRoche Inc., Boniva's maker, has been asked to stop claiming the drug is as effective as Proctor and Gamble's Actonel and Merck's Fosamax, the market leader.

Louisville Woman Files Fosamax Lawsuit

Suffering from what amounts to a rotten jawbone, a Louisville, KY woman has filed a Fosamax lawsuit against Merck claiming the drug is responsible for the development of Osteonecrosis in her jaw.

There's no mention of such a potential side effect in commercials advertising the claim.
In 2005, at the request of the FDA, Merck did add a warning. That's found on a 22-page document that prescribing pharmacies receive.
