Matters of Medical Malpractice in NYC have flooded the streets for years now and people are fed up with the substandard care that is presently being administered. People are not only fed up with the level of care but they are also fed up with the high price that comes along with this substandard care. Medical Malpractice Long Island Raises Significant Issues

At this very moment the United States is dealing with some very significant issues that may change the nation to its very core. Not only are we about to vote on the next President of the United States, but we are also dealing with a major economic crisis. The housing market has burst and health care is so expensive millions of families are finding themselves without it. It our current position people are hanging on to the hopes that our next president will bring us out of this recession and get us back on track. However the most prevalent issues surrounding the race have provided for very vast views between each of the candidates. The most prevalent issues being the war in Iraq, the economic crisis, taxes & governmental spending, forms of alternate energy, education, and health care. The recent debates have showcased the differences between both candidates in more ways than one. One of the most prevalent issues that has people talking are the different views regarding healthcare. Healthcare may be one of the most controversial and prevalent issues because it affects every single American in the United States. The fact of the matter is that the stance on healthcare is directly related to most of the other significant issues that has Americans up in arms. For example, the current economic crisis is going to make it harder for people to afford healthcare and for institutions to fund proper medical programs. With over 8 million people living in New York City alone, you would not be skeptical that the rate of medical malpractice is quite high. In late summer, the rate of medical malpractice insurance was frozen due to many practices being forced to go out of business due to high insurance costs. Officials have been working to find a solution to this matter and are doing everything in their power to ensure a reasonable and reliable outcome. Acts of medical malpractice in New Jersey have been affecting the state and the rest of the country with every single additional occurrence. Doctors are now realizing that now is not the time to compromise health care because simply no one can afford to go through the court proceedings. U.S. Department of Labor to Aid Louisiana from Hurricane Gustav

With the recent devastating effects from various hurricanes surrounding the South, Louisiana is yet again in dire need for assistance. The U.S. Department of Labor has revealed that they will give over $20 million dollars in aid to Louisiana. Hurricane Gustav has caused Louisiana to be in a national state of emergency, in which this money will be in the form of a grant to help workers who were harmed by the hurricane. Unfortunately this form of natural disaster is not new to the state of Louisiana, which has seen devastating effects from a multitude of hurricanes originating in 2005 from hurricane Katrina. The U.S. Department of Labor’s funds that are aiding the cause are going to be used to provide workers with temporary jobs to help clean up the area from hurricane Gustav. Other funds stemming from the same pot will go to provide inhabitants of the area with the basic needs of food, water, and shelter.

New Safety Standards in Effect for Kids Toys

The Consumer Product Safety Commission revealed that Kid’s items must meet new safety standards despite when the item was manufactured. Every single product that is marketed and targeted to children must meet these standards by February 10th 2009. This new standard is going to cost a lot of money in manufacturing revisions, and rightfully so. The CPSC is allowing businesses to sell the rest of their remaining stock of children’s products until the February 10th deadline. After the deadline hits, any product that does not comply with the new safety standards will not be allowed to be sold on the market. This regulation also applies to children’s products that are exported as well; therefore it is imperative for these manufacturing companies to make the revisions as soon as possible. For any product that does not comply will be utterly useless.

MetroLink Los Angeles Accident Becomes Subject for Personal Injury Lawsuits

The Metrolink accident that occurred in Los Angeles on September 12th ended up killing 25 people and left 130 significantly injured. The Metrolink accident occurred after the Metrolink’s train engineer failed to stop at a red light, which in turn collided with a Union Pacific freight train. The Metrolink train had approximately 225 passengers aboard when the event occurred causing Metrolink’s engine to be pushed back into the first seating car. The details to why the Metrolink’s train engineer did not stop at the red light are being heavily investigated. The Metrolink’s train engineer had over 15 years of experience so negligence on behalf of the engineer is not the sole suspicion but has also not been ruled out. The National Trasport Safety Board is looking into the possibility that the light box may have been out of order or that there was a sufficient glare on the light that the train engineer could not tell the difference between the colors. Train signals are regulated from a Metrolink control center in Pomona CA, which was reported to be working properly.

Staten Island Ferry Crash: Settlement of 1.4 Million for Wrongful Death

The Staten Island Ferry crash of 2003 devastated many lives killing 11 people and injuring thousands. The boat crashed into a maintenance peer due to the assistant captain unable to control the equipment. The assistant captain lost control because of fatigue from taking painkillers. The state of New York tried to limit its liability on the matter but the federal courts did not rule in their favor. The federal courts decided that the state of New York acted negligent in the matter because the state failed to employ back up help in case of an emergency. If there was another employee nearby they could have stopped the crash from happening all together. Since the city was found negligent, they are responsible for all of the consequences resulted from the accident. From the time when the incident occurred back in 2003, there have been over 127 settlements totaling in over $38 million dollars.

Forced Second Recall for Simplicity’s Cribs

About one year ago one of Simplicity’s Bassinets contributed solely to the death of a 4 month old. After the devastating event, Simplicity was in rare form in which their only option was to either refinance or get bought out. Their financing situation could no longer be supported so their lender sold their assets to a private-equity fund. This sale to the private-equity fund alluded to problems in enforcing the recall by Federal Regulators. However, to make matters worse just two months after the first death, recall, and sale of the company, a second baby was killed due to the faulty bassinet.

There have been more and more instances of drugs attributing to negative complications that have all been approved by the FDA. All of these instances have produced negative complications that have risen from the approved drugs. Where do we draw the line, and how to we go about making sure that the line is regulated. Zetia/Vytorin has been severely investigated on accounts for failure to provide evidence that the drug reduces heart attacks or cardiovascular disease. Sales of this drug have reached over $5 million last in only one year, which means there is a large demand and target market that is buying the drug. Prescriptions are being filled at an alarming rate, which is essential causing the drug to maintain high profits.

Malpractice Settlements At an All Time High

Medical malpractice settlements have reached an all time high incorporating billions of dollars a year. Insurance companies, medical institutions, and individual practitioners have given out this large sum of money due to medical professionals committing errors that significantly harm a patient. Medical malpractice damages the victim’s entire life, in most cases leaving them debilitated and out of work. Medical malpractice often handicaps a victim leaving them in a state of depression, which can lead to suicidal tendencies. A victim of medical malpractice, lets say from a medical professional committing a misdiagnosis, will not be able to earn a living for their family for the rest of their life. They will not be able do many things that people take for granted everyday. Energy Crisis in NY could be Curtailed with New Wind Tunnels, But Priority on Safety must not be Overlooked to Avoid Labor Law Issues

If you asked any on the streets about our current energy crisis I’m sure the consensus would be a negative one. The energy crisis is causing increased prices in many different areas, the most poignant being oil. This spike in oil has affected the entire economy, in which our nation has been trying to desperately to find a solution. The thought of alternative energy has been engraved in our brains to something that must happen. However, at what expense are we trying to make these changes at. Yes, we need alternate energy and yes we need it as soon as possible. But what are we going to give up in return to make this dream a reality. In November we are going to vote on a president that will ultimately where our economy is going to go. This is a pivotal decision that must be made in angst to make sure that the citizens of the country have a say into where we want our economy to go. Both spectrums, both candidates offer two distinct methods for fixing our crisis, therefore we must be very careful in determining our options. People of the United States have different preferences, futures imagined, and plans for our country but we must come together, like we have so many times in the past, and do what we can for our country.

One of the reasons why the FDA is in place is to control the type of prescription drugs that are available on the market. It is necessary for the FDA to keep and watchful eye on the practices of pharmaceutical companies so that they do not introduce drugs that are not safe for consumer use. The FDA regulates what types of drugs are introduced in the market by conducting laboratory tests to ensure safety. However, unsafe drugs commonly appear on the market causing harm to consumers. It has been speculated that Axminister has been manufacturing Baby Sleepsafe monitors that can fail to regulate the baby’s breathing. The device has been known to malfunction easily because it has a poor structure for the battery compartment. The issue lies in the battery compartment where the metal springs that are supposed to support and keep the batteries in place are not of standard quality. There have been many cases in which the battery compartment has come apart easily and failed to regulate the baby’s breathing. This situation has caused widespread stipulation as to whether deaths of babies in the past have been partly attributed to this malfunction. Maple Leaf’s Sure Slice Delicatessen Meats Recalled

Maple Leaf announced a recall of its Sure Slice Delicatessen meats on August 19th 2008. Maple Leaf’s meat products were exposed to Listeria at its Bartor Road plant in Toronto. Listeria is a bacterium that is food based causing infection and a fatality rate of approximately 25%. Maple Leaf was forced to close its Bartor Road Plant in Toronto because of the bacteria, using this time for decontamination. “Canadian health officials said yesterday that 21 cases of listeriosis, including four deaths, have been confirmed in four provinces, and an additional 30 cases are being investigated. The officials expect the number of cases will rise because the incubation period of listeria can be as long as 70 days.”

Restroom attendants are the heat of the investigation for Portlock Maintenance has been found to employing restroom attendants but not paying them wages. Portlock Maintenance was only allowing their restroom attendants to rely on tips in which they were also forced to give back 50% of the tips that they earned. Portlock Maintenance has also been found to not only force these practice in the State of New York, but also in New Jersey and Connecticut.

Increases in Registration Fees for Medical Devices Issued by FDA

The FDA has recently announced that they are going to be increasing the registration fees for medical devices starting in 2009. This decision will affect those medical devices that are imported by foreign nations that are trying to come into the United States. “This is because foreign establishments engaged in the manufacture of medical devices imported into the U.S. must register their establishments and provide the FDA with the name of the U.S. agent representing their establishment.” The increase in registration fees will only be about a $150 dollars, but nevertheless still an increase. Using Codeine to Treat Pain while Breast Feeding has been Linked to Cause Personal Injury in Newborns

Class Action Product Liability Case Against DaimlerChrysler Failed

The class action product liability case against DaimlerChrysler was put to rest as the judge sided with the defendant because it was proven that the plaintiffs did not incur problems with head gaskets until after warranty expired. The delayed filing of the class action suit also played a part in the failure of the suit because the complaint was filed after the statue of limitations had run out. The class action suit had alleged that the Neon, manufactured by Dodge, was built with defective head gaskets. The class action case’s complaint sited that DaimlerChrysler broke their duty of express and implied warranties, as well as committing fraud. However, the judge did not find this to be true and found that the plaintiff’s Dodge Neon was no longer under warranty when it began experiencing problems.

Lawsuit Issued do to Use of Illegal Kickbacks for Medical Devices

Intermedics-McCullough, a Pennsylvania medical supply manufacturer, is suing six other manufacturers for using illegal kickbacks to sell their medical devices to medical institutions, hospitals, and doctors alike. Intermedics-McCullough is stating that the manufacturers are offering these illegal kickbacks to have exclusive rights for their products to be sold despite the fact that they are more costly and are inferior to McCullough’s products. The medical devices in question are those in the orthopedic industry, specifically manufacturing replacement hip, knee, and joint implants. The six medical device manufacturers involved in the lawsuit are Zimmer Inc & Zimmer Holdings Inc, DuPuy Orthopedics & Biomet Inc, all of Warsaw, Ind, Smith and Nephew Inc. Of Memphis, Tenn.; Stryker Orthopedics of Mahweh, N.J and Stryker Inc of Kalamazoo, Mich.

Wal-Mart may be at fault for Violating Election Laws, Labor Unions to Question

Seroquel

Seroquel, also known as Quetiapine, is a drug that is used to treat schizophrenia and other psychotic disorders. Product Liability: Peanut Butter Case Ruled Negative for Class Action Suit

It all started with a batch of Salmonella tainted peanut better, which was found in ConAgra the producer of Peter Pan and Great Value peanut butter. A class action suit was being put together and was brought to court, in which the judge determined that filing a class action suit would not be the most efficient way to distribute compensation because there are two different classes of people involved with the litigation. The first group consisted of people who bought the peanut butter containing salmonella bacterium, and the second group is those who got sick or died from consuming the tainted peanut butter.  The judge rules for ConAgra to pay $33million dollars to Peter Pan retailers and consumers would be a far more efficient settlement than continuing on with a class action suit.

Pilot Union Sued by United Airlines

United Airlines has asked that the Air Line Pilots Association to stop from supporting its pilots to participate in an illegal and disorderly sickout, or protest against United’s plan to cut its pilots in an effort to reduce expenses.  United Airlines brought this suit up with the U.S, District Court in Chicago. United Airlines’ claimed that the Air Line Pilots Association Union and four specific pilots had violated the Federal Labor Law that forbids transportation workers from performing work slowdowns. Pilots and flight attendants work on a pay system that is determined from the length of the trip, in which employees can gain more revenue if there is some type of hold up. Due to some of United’s workers deliberate slow downs, United was forced to delay and or cancel over 300 flights occurring in the last two weeks in July. These cancellations amount up to a big sum of lost revenue. Specifically, the cancellations cost upwards to a multiple of millions of dollars, a tainted reputation, and the interference of over 30,000 passengers travel plans.

Late-Notice Rule in New York is now in the hands of the Insurer

In 2009, no longer will New York allow a personal injury or wrongful death insurer to file to claim coverage because of a late notice. This new rule will stand despite the fact or not if the insurer experienced harm by the postponement. Governor David Paterson signed the bill that also permits an injured party to seek a judgment for either personal injury or wrongful death. This would allow the petitioner to determine if the extent of the insurance coverage would be worth pursing.  Those who opposed the bill said, “it will somewhat level the playing field between insurers and consumers when insures fail to file claims for injuries deemed late for coverage.” This latest law will not allow insurers to disclaim coverage for claims that are past their term, however if they can prove that they were “materially prejudiced” by the postponement they may be able to get out of the new law.

Medical Malpractice: Decrease In Insurance Rates

Wrongful Deaths Chalked up to Prescription Drug Use

            Many deaths have been attributed to taking medication that end up causing more harm then good. FDA Warning: CT Scans May Cause Medical Device Malfunction

Medical Malpractice NY Case: Women Awarded $17 Million

Brenda Schenk, a resident of Henrietta New York, was awarded $17 million in damages for past and future injuries, pain, and suffering. This incident unfortunately happened as Schenk was anticipating the birth of her child. Gardasil Vaccine Connected to 18 Fatalities

    It all started 2 years ago when Merck & Co. started administering Gardasil, a cervical-cancer vaccine, to girls and women. Over 8,000 adverse reactions have been recorded by the Federal health officials. Gardasil was licensed by the Food and Drug Administration in June 2006 for females ages 9 to 26. Sold worldwide, it's been given to more than 8 million US girls and women, Merck says. The vaccine is aimed at warding off strains of the human papillomavirus, or HPV, which can lead to cancer. The vaccinations cost a total $360. Securities and Exchange Commission documents show Merck made $1.5 billion in Gardasil sales last year.    However, Gardasil has produced such bad reactions in girls and women who have taken the drug, that it has been linked to 18 deaths. Schools have been administering the drug, saying that it protects girls from cervical cancer. However, there have been cases reported of pancreatitis, immune system disorders, lethargy, paralysis, seizures and brain damage after receiving the shot. Most of these cases have been seen in teenage girls due to the high push for schools to administer it.     The most common side effect of Gardasil is fainting. In which Merck spokeswoman Kelley Dougherty said the company "actively monitors" reports of side effects. The Vaccine Adverse Event Reporting System, run by the FDA and the Centers for Disease Control and Prevention, has collected thousands of reports of health problems after Gardasil shots. Of these fatalities they included a heart rhythm disorder, severe allergic reactions, and d the 10 confirmed deaths, there was no common thread and that Gardasil was not to blame. "An event report does not mean that a causal relationship between an event and vaccination has been established - just that the event occurred after vaccination," she said. A Post analysis of adverse- event reports filed through April 30 found that about 20 percent followed injections of Gardasil, plus up to seven other vaccines at the same time - including shots to prevent flu, chicken pox, hepatitis and tetanus. Almost 6,300 cases involved Gardasil alone. Under a federal law passed in the late 1980s, victims of vaccines may file a claim under the Vaccine Injury Compensation Program, but cannot sue the pharmaceutical.    Administration of Gardasil in schools makes for parents, teachers, and students alike to think that the drug is safe. Ancure

The Guidant Ancure system is a blood vessel graft that is used to repair an abdominal aneurism. An Aneurysm is a diseased or weakened section of the artery wall that tends to balloon or bulge due to arterial blood pressure (defined by the FDA). It is used instead of the more invasive open surgery in patients who have an abdominal aortic aneurysm and whose anatomy is not suited for the use of the single tube or bifurcated endograft device. The Ancure device, as part as the Ancure Endograft System, was suspended in 2001 by its manufacturer Guidant.  Ancure is a synthetic graft device that is used to repair abdominal aortic aneurysms. The device was suspended due to the fact that Guidant admitted to making false statements to the FDA and not submitting required reports of injuries that occurred in patients who received the Ancure device. Injuries occurring with the Ancure device include leaks, aneurysms, and ruptures which resulted in extended hospitalizations, additional surgeries, and sometimes death.

Medical Devices

When there are flaws in a medical device’s design and/or manufacturing, it can cause injury and even death. A patient looks to these medical devices for help, but in some cases the devices end up hurting rather than helping. The FDA is responsible for the approval and oversight of these devices, and when flaws arise, major problems arise as well. When a patient with a heart murmur is relying on their pacemaker to keep them alive, the workings of the device is crucial to the life of the patient. What would happen if a pacemaker stopped working and left the patient without the support that they needed? In a situation like this, it is important to have a lawyer that has the experience in dealing with large insurance companies, corporations, and the government.

Labor Law

Due to over 6 million occupational work related injuries in one year alone, there is a great need for increased regulation. Labor law is the body of laws, administrative rulings, and precedents which address the legal rights of, and restrictions on, working people and their organizations. Occupational health and safety issues are most prevalent in blue collar workers; however there has been a rise in white collar worker disputes as well. Labor law is a cross-disciplinary area concerned with protecting the safety, health and welfare of people engaged in work or employment. With all of these regulations set in place you would think officials have a good grasp on the matter. However, due to substandard equipment, poor safety procedure, and a lack of proper training, detrimental accidents occur in the workplace are leaving employees injured and out of work.

Trouble for Bayer as Lawsuits Draw Near

The suspension of Trasylol, a drug used in heart surgeries sales that has been proven to be fatal, has caused for much talk. Trasylol lawsuits from the families of those affected by the drug’s side-effects will be filed soon, and a Trasylol class-action lawsuit can not be far off. With fatalities over 22,000, Bayer is going to be struggling to find a way out. The drug was speculated to have problems back in 2006, yet it was still approved by the FDA. The reason for this is that Bayer failed to present their research about the relation of kidney failure & Trasylol to the FDA in their September 2006 meeting. The chairman of that FDA advisory panel, Dr. William Hiatt, said that he would have voted for a Trasylol recall back in 2006 if Bayer had not withheld the data from their study

Bayer Recalls Popular Drug Used In Heart Surgery

Bayer Pharmaceutical, the large drug manufacturer, has announced that it has taken its remaining stock of Trasylol out of hospitals. This anti-bleeding medication has been linked to causing kidney damage and death in over 22,000 cases. The reason that Bayer recalled the drug was in response from studies that show Trasylol nearly doubled the death rate in comparison to cheaper alternative medications that were already established in the market. These studies that proved Trasylol, also called aprotinin, is more dangerous when used in heart surgeries were given to Bayer nearly two years before it was taken off the market. Bayer even did their own study, in which the finding also discovered the fatal side effects of the drug.
